A Advogada Criminalista Suéllen Paulino fala sobre as novas previsões legais da Lei
| Em um avanço importante no combate à violência doméstica, foram sancionadas em abril duas novas Leis que ampliam os instrumentos de proteção da Lei Maria da Penha, adequando a legislação aos desafios contemporâneos, como o uso da tecnologia para a prática de abusos. Monitoramento Eletrônico do agressor A Lei nº 15.125/2025 acrescenta ao Artigo 22 da Lei Maria da Penha a possibilidade de o juiz, ao conceder Medida Protetiva de Urgência, determinar o uso de monitoramento eletrônico pelo agressor. Além da tornozeleira, a vítima poderá ser equipada com dispositivo que a alerte caso o agressor se aproxime. De acordo com a Advogada Criminalista Suéllen Paulino, a nova previsão legal tem como principal objetivo evitar o descumprimento de Medidas Judiciais de Afastamento, que, infelizmente, em muitos casos, não são respeitadas, resultando em episódios de feminicídio ou agressões ainda mais graves. “Com o uso da tornozeleira, a localização do agressor será controlada em tempo real e a polícia poderá agir imediatamente em caso de risco”. Advogada afirma que essa medida, que antes dependia de iniciativas isoladas de alguns Estados, passa agora a ter respaldo nacional e poderá ser aplicada sempre que o juiz entender necessário, o que representa um importante avanço na proteção da mulher em situação de vulnerabilidade. Violência digital com inteligência artificial A segunda medida sancionada, a Lei nº 15.123/2025, altera o Código Penal para prever aumento de pena nos casos de violência psicológica contra a mulher praticada por meio de manipulações digitais, como vídeos falsos, deepfakes e conteúdos produzidos por inteligência artificial. “A pena, que era de 6 meses a 2 anos de detenção com multa, passa a ter um aumento de 50% se houver o uso dessas tecnologias para humilhar, intimidar ou expor a vítima”, explica Suéllen Paulino. De acordo com a Advogada, o Congresso reconheceu que, diante da sofisticação das ferramentas digitais, o dano psicológico provocado por montagens e conteúdos falsos tem potencial destrutivo e precisa ser combatido com maior rigor. “Essas práticas, muitas vezes disseminadas em redes sociais e grupos privados, violam a dignidade da mulher e podem gerar consequências gravíssimas para sua saúde mental e sua vida social e profissional”, pontua. Modernização necessária Suéllen destaca que as novas Leis refletem uma tendência legislativa de modernização da proteção às vítimas de violência doméstica e familiar, respondendo a lacunas antes exploradas pelos agressores, inclusive no ambiente digital. “Ao reforçar as Medidas Protetivas com tecnologia e endurecer a punição para abusos virtuais, o Estado brasileiro dá um passo importante para assegurar que a Lei Maria da Penha continue sendo um instrumento eficaz de defesa da vida, da integridade e da liberdade das mulheres”, conclui. |
